When counseling clients, Brooks R. Bruneau balances the client’s business goals and legal needs against business costs to achieve  the desired outcome based on a thorough analysis. Whether a  Fortune 500 or a  start-up company, clients trust him to protect their intellectual property.    His clients’ industries include pharmaceuticals, designer clothing and cosmetics, software, large scale manufacturing, consumer products, food manufacturers and distributors, and winemaking.  He knows what it takes to protect intellectual property and has a willingness to aggressively pursue any infringement to a client’s rights.

Mr. Bruneau concentrates his practice in trademark and copyright litigation, prosecution, licensing, and counseling on the clearance and registration of clients’ trademarks, both in the United States and globally.  He also handles disputes concerning false advertising, e-commerce and Internet domain names throughout the United States. His practice further includes searching and clearing trademarks, prosecuting trademark applications, and supervising the maintenance of clients’ trademark portfolios, both large and small. Litigating issues over registration of trademarks is highly specialized and is governed by the Trademark Trial and Appeal Board Administrative Court.  Mr. Bruneau is not only highly experienced but also highly regarded for his skills and successes before the Board. 

Advising on creating and protecting product trade dress in a client’s particular industry is one of Mr. Bruneau’s strengths as well and involves both dealings with the United States Trademark Office, and the Federal Courts.  He has significant experience in trade dress matters and counsels clients about protecting their rights in product packaging designs, including containers and product configuration. When litigation is necessary, he is an experienced litigator in the trade dress field, and counsels clients on strategy for enforcing or defending against such claims.

His litigation experience and skills also include protecting and defending clients in trade secret and false advertising matters.  With regard to false advertising, Mr. Bruneau counsels clients on comparative advertising issues, advertising claims of their products, and appropriate use of the client’s trademarks in marketing materials.

As part of his commitment to help clients reduce the stresses, distractions and costs of litigation, Mr. Bruneau has become a skilled negotiator.  He utilizes creative approaches to seek alternative forms of settlement for clients, and always keeps the client aware of the costs and benefits or detriments to any settlement option.  Because he stays focused on what is best for the client and its business, he considers obtaining a successful settlement for a client as gratifying as winning in court.
