Defendants in a high stakes class action lawsuit have good reason for concern. Attorneys in Porzio’s Life Sciences Industry Group have substantial experience defending class action cases as both primary counsel and local counsel to national defense teams. We have defended class actions asserting a variety of claims, including consumer fraud, strict liability, medical monitoring, negligence, warranty, contract, and property damage.
We served as lead counsel to the world’s largest distributor of medical products in a nationwide price gouging case arising out of the sale of flu vaccine. We defeated the plaintiffs’ motion to compel disclosure of confidential customer lists, limited class-related discovery to one region of the country, and obtained a dismissal of the putative class. The trial court’s opinion in West Morris Pediatrics v. Henry Schein, Inc., 385 N.J. Super. 581 (Law Div. 2004), is one of the few published class certification decisions in New Jersey. We prevailed in the New Jersey Appellate Division when plaintiffs’ counsel sought to challenge the trial court’s grant of a modest fee award after we had settled the claims of the two denominated plaintiffs for a nominal amount.
We acted as co-counsel and one of the first firms in the nation to actually try a medical-monitoring class action in a product liability case. Our work in the Vadino v. Wyeth diet drug case contributed to a nationwide settlement of claims.
